Mahlon G. "Bud" Funk is a trial attorney with extensive experience in federal and state courts in Virginia in a wide variety of litigation matters. He has represented clients in matters as diverse as medical and professional malpractice, personal injury, wrongful death, family law, employment law, estate and trust litigation, land-use litigation, bankruptcy adversary hearings, savings and loan institution failures, law firm and physician practice group split-ups, state agency administrative hearings, securities arbitration, tax litigation, public utility regulatory proceedings and white collar crime. Bud currently heads up the firm's specialized Catastrophic Injury Practice Group that handles catastrophic and complex injury and death cases for plaintiffs -- including traumatic brain injury, medical malpractice, defective product injury, wrongful death and transportation/highway injury.

Representative Experience:

  • Representation of plaintiffs in medical malpractice, products liability, automobile, premises liability, and other personal injury and wrongful death claims that have resulted in substantial, high dollar verdicts and settlements (both structured and unstructured); including the first seven-figure medical malpractice verdict in the Richmond area and second in Virginia.
  • Representation of clients in numerous state courts in family law litigation involving equitable distribution of businesses and other substantial marital assets.
  • Representation of a large Virginia municipality in consolidating and defending over two hundred fifty lawsuits filed against the municipality by developers as a result of the municipality's amendment of its zoning ordinance to substantially restrict permitted office building locations, densities and uses. These suits sought damages aggregating in excess of $1 billion. The developers were represented by a number of the largest law firms in Virginia and Washington, D.C. The trial proceedings lasted over one year, with subsequent appeal to the Virginia Supreme Court, resulting in a decision in the municipality's favor on all issues.
  • Representation of clients against national and regional securities brokerage houses in federal court and arbitration proceedings involving unauthorized trading, unsuitable trading, churning, fraud, and futures and options trading schemes, including a multimillion dollar claim involving sophisticated foreign currency trading.
  • Representation of broker-dealers, brokers and others in connection with noncompete agreements and other employment matters.
  • Representation of shareholders and companies in derivative, fraud, mismanagement and minority shareholder oppression claims.
