Mike Terry began his practice in the commercial real
estate section of Hirschler Fleischer, representing
several lending institutions in connection with their
loans and investments in Virginia and throughout
the southeast. Mike also had the opportunity to
represent developers, property owners and tenants
in connection with the acquisition, development and
leasing of raw land for planned unit developments,
retail projects and office complexes.
During the late eighties and the early nineties, while
retaining a transactional practice, Mike’s practice
increasingly became occupied with representing
lenders and borrowers in financial restructuring and
pre-bankruptcy planning and negotiation. Mike has
successfully assisted the financial restructuring of a
wide range of commercial businesses and real estate
development companies. He has also represented
numerous lenders, inside and outside of bankruptcy,
in collecting their credit and realizing upon their
collateral. Mike’s experience in financial workouts/
reorganizations led to a practice consulting with
business owners and negotiating on their behalves
with respect to organization of assets, general business
planning and division/dissolution of business
organizations (business divorces). Another evolving
area of Mike’s practice has been his representation of
financial institutions and investors in the purchase
and sale of loan portfolios and servicing portfolios.
Mike continues to have a broad practice involved
in all aspects of commercial real estate and finance.
Over the past year, Mike has represented owners of
real property in sales, acquisitions, financings, lease
transactions and Sections 1031 and 1033 exchange
transactions. Mike represented the lead lender in
connection with the negotiation and syndication of a
construction loan in excess of $100 million.
Mike graduated magna cum laude from the
University of Richmond where he was inducted into
Phi Beta Kappa Society, as well as the University’s
political science and history national honorary
fraternities. He obtained his law degree from the
College of William and Mary, where he was named
a John Marshall Fellow.
He has published articles on real estate and contract
law and has given numerous lectures on real estate,
contract and workout/reorganization topics (including
lectures sponsored by the National Business
Institute and the Committee on Continuing Legal
Education of the Virginia Law Foundation). He is
the co-author of four chapters of a text on Contract
Law published by the Virginia Law Foundation.
A member of the Virginia bar, Mike is rated “AV” by
Martindale-Hubbell Law Directory and is included in
the current and past editions of The Best Lawyers in
America. Additionally, Mike was named a member of
“Virginia’s Legal Elite” by Virginia Business magazine.
Mike is a member of the American College of Real
Estate Lawyers (ACREL), a prestigious organization
dedicated to furthering the practice of real estate
law. Mike was named as a “Band 1” Leading
Individual Real Estate Lawyer in Southern Virginia
in 2008 and as a Leading Individual Real Estate
Lawyer in Virginia since 2004 by Chambers USA.
Mike has been listed as one of the “Top 50” lawyers
in Virginia by Super Lawyers.
Mike is a past-Chairman of the Commercial Real
Estate Section and is the Executive Vice President of
Hirschler Fleischer and serves on the firm’s Board
of Directors and Executive Committee.
